These Terms and Conditions govern access to and use of HuTraits, including account creation, teacher profile publication, messaging, bookings, payments, cancellations, refunds, and support. By using the platform, you agree to these terms and to the related policies published on the site, including the Privacy Policy, the Payments and Refunds Policy, and the Cookies Policy.

1. Nature of the platform

• HuTraits is an educational technology platform that helps users discover teachers, compare profiles, communicate, book lessons, and manage educational sessions.
• Teachers using the platform generally provide their educational services as independent service providers unless HuTraits expressly states otherwise in a separate written agreement.
• The platform facilitates discovery, review, booking, payment, communication, and certain operational workflows, but it does not guarantee a specific academic outcome.

2. Eligibility and account responsibility

• You must be legally capable of using the platform, or use it with appropriate supervision and authorisation where required by law.
• You must provide accurate, complete, and current information when registering or using the platform.
• You are responsible for keeping your login credentials confidential and for activity taking place through your account unless the law states otherwise.

3. Teacher profiles and approval

• A teacher profile does not become publicly visible until it has been reviewed and approved by the platform.
• The platform may request amendments, reject a submission, suspend visibility, or deactivate a profile where the information is incomplete, misleading, unlawful, or inconsistent with platform standards.
• Teachers are responsible for ensuring that their profile information, pricing, media, and teaching claims remain accurate and lawful.

4. Student use and bookings

• Students are responsible for reviewing booking details, timing, pricing, and teacher information before confirming payment.
• Bookings, schedules, and lesson access are subject to platform rules, availability, timezone conversion, payment validation, and operational review where applicable.
• The platform may update a booking status for legitimate technical, financial, security, dispute, or compliance reasons.

5. Prices, payments, and commission

• Displayed pricing at the time of booking is the primary commercial reference for the relevant booking.
• Payments may be processed through third-party payment providers, wallet balance, or approved manual payment methods.
• Teacher earnings and platform commission are subject to the active commission rules and financial records associated with the booking.

6. Cancellations and refunds

Cancellations and refunds are governed by the Payments and Refunds Policy and any operational rules clearly presented at the time of booking. Any statutory consumer rights that cannot legally be excluded remain unaffected.

7. Communications and conduct

• Users must communicate respectfully and lawfully through the platform.
• It is prohibited to send unlawful, abusive, threatening, fraudulent, misleading, or rights-infringing content.
• The platform may review, retain, restrict, or disclose messages or related records where reasonably necessary for support, safety, moderation, compliance, or dispute handling.

8. Prohibited uses

• Creating fake accounts, impersonating others, or providing materially misleading information.
• Attempting to bypass platform rules, tamper with payments, misuse bookings, scrape data, or interfere with system integrity.
• Uploading unlawful content or content that violates privacy, intellectual property, or other legal rights.

9. Intellectual property

• The platform, its software, branding, design, and proprietary materials remain owned by HuTraits or its licensors, except where rights are clearly held by users.
• Users retain rights in the content they upload, but grant the platform a non-exclusive licence to use that content to operate, review, display, moderate, and improve the service.

10. Suspension and termination

The platform may suspend, restrict, or terminate access to the service, a profile, a booking flow, or an account where there is an actual or suspected breach of these terms, security risk, fraud concern, legal obligation, or operational necessity.

11. Disclaimers and limitation of liability

The platform is provided on an “as available” basis, subject to applicable law. To the fullest extent permitted by law, HuTraits is not liable for indirect or consequential losses, loss of profits, loss of opportunity, or similar losses arising from use of or inability to use the platform. Nothing in these terms excludes liability that cannot legally be excluded.

12. Governing law and updates

These terms may be updated from time to time to reflect legal, commercial, technical, or operational changes. The latest published version will apply from its effective date. Any governing law, mandatory consumer rights, or dispute-resolution rights that apply by law remain preserved to the extent required.
